These Terms and Conditions govern your booking, payment, and participation in skateboarding lessons, coaching sessions, education programmes, events, or any related services (collectively, the "Services") provided by SkateEdu Pte. Ltd. ("we", "us", "our", or "SkateEdu"), a company registered in Singapore. By booking or participating in our Services, you (and, if applicable, the parent or legal guardian on behalf of a minor participant) agree to be bound by these Terms.

 

1. Bookings and Payments

  • Bookings are confirmed only upon receipt of full payment.

  • Payments are processed securely through our designated platforms (e.g., Stripe or bank transfer).

  • Prices are as stated at the time of booking and may include GST where applicable.

  • Bookings are non-transferable without our prior written approval.

 

2. Cancellation and Refund Policy

  • Fees are generally non-refundable due to the personalised nature of our Services.

  • In exceptional circumstances (e.g., serious illness or injury supported by medical documentation), we may, at our sole discretion, offer a pro-rated credit or refund.

  • No refunds or credits for no-shows, late arrivals, or voluntary withdrawal.

  • If you provide at least 48 hours' notice to cancel or reschedule, we will endeavour to offer a credit or alternative slot, subject to availability.

  • We reserve the right to deduct reasonable administrative fees from any credits or refunds.

  • This policy complies with the Consumer Protection (Fair Trading) Act (CPFTA) and other applicable Singapore laws.

 

3. Rescheduling or Cancellation by SkateEdu

  • We reserve the right to reschedule, postpone, or cancel Services due to inclement weather, instructor illness, low enrolment, venue unavailability, force majeure, or other unforeseen circumstances.

  • In such cases, we will offer alternative dates, a credit note, or (where no alternative is feasible) a pro-rated refund.

  • We will notify you via email, phone, or SMS as soon as practicable.

 

4. Participation and Safety

  • Participants must arrive on time, wear appropriate safety gear (helmets are compulsory; elbow/knee pads and wrist guards are strongly recommended), bring their own skateboard (or rent one if available), and follow all instructions from our qualified instructors.

  • Skateboarding involves inherent risks, including but not limited to falls, collisions, equipment failure, and serious or permanent injury.

  • Participants engage in the Services at their own risk and are responsible for ensuring they are physically fit to participate.

 

5. Assumption of Risk, Release of Liability, and Indemnity

To the fullest extent permitted by Singapore law, including the Unfair Contract Terms Act (Cap. 396):

  • You (on your own behalf and, if applicable, on behalf of the minor participant) acknowledge and voluntarily assume all risks associated with participation in the Services, whether known or unknown.

  • You hereby release, waive, discharge, and agree not to sue SkateEdu, its instructors, employees, agents, venue owners, event partners, sponsors, affiliates, and associated parties (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising from death, personal injury, property damage, or any loss related to participation in the Services, including those caused by ordinary negligence of the Released Parties.

  • This release does not apply to liability arising from gross negligence or wilful misconduct of the Released Parties, or where prohibited by mandatory Singapore law.

  • You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) brought by or on behalf of you, the participant, or any third party, arising out of or in connection with:

    • Participation in the Services.

    • Any injury or damage caused by you or the participant to others.

    • Breach of these Terms or failure to follow instructions.

 

6. Health and Fitness

  • You must inform us in advance of any medical conditions, injuries, allergies, or limitations that may affect participation.

  • We reserve the right to refuse or terminate participation if, in our reasonable opinion, it poses a safety risk to the participant or others. No refund will be provided in such cases.

 

7. Photographs, Videos, and Media Usage

  • We may capture photographs, videos, audio recordings, or other media (the "Media") during the Services for promotional, educational, marketing, archival, or other lawful purposes (e.g., on our website, social media, brochures, or advertisements).

  • By participating in the Services, you (and the parent/legal guardian for minors) grant SkateEdu and the Released Parties an irrevocable, royalty-free, worldwide licence to use, edit, reproduce, distribute, and publish the Media featuring your (or the participant's) likeness, image, voice, or performance, without further compensation, notice, or approval.

  • You waive any rights to inspect or approve the Media and release the Released Parties from any claims related to its use, including under privacy or publicity rights.

  • If you (or the minor participant) do not consent to this Media usage, you must notify us in writing (via email to start@skateedu.com) at least 24 hours before the Service commences. We will make reasonable efforts to exclude you/the participant from Media capture, though this may limit involvement in certain activities.

  • All collection, use, and disclosure of personal data in Media complies with our Privacy Policy and Singapore's Personal Data Protection Act 2012 (PDPA). For minors under 13, parental/guardian consent is relied upon.

 

8. Personal Data

  • We collect, use, and disclose personal data (including that of minors) in accordance with our Privacy Policy and Singapore's Personal Data Protection Act 2012 (PDPA).

  • You consent to such processing for purposes related to the Services, including contact, safety, administration, and marketing (with opt-out options available).

 

9. Conduct and Behaviour

  • Participants must behave respectfully towards instructors, other participants, and venue staff.

  • We reserve the right to remove disruptive or unsafe participants without refund.

 

10. Intellectual Property

  • All lesson materials, techniques, and content provided by SkateEdu remain our intellectual property.

 

11. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the Republic of Singapore.

  • Any disputes shall be subject to the non-exclusive jurisdiction of the Singapore courts.

 

12. Changes to Terms

  • We may update these Terms from time to time. The latest version will be posted on our website and/or provided at booking. Continued participation after changes constitutes acceptance.
